“Conviction Stands: Surrey Six Killer Denied Appeal”

Date:

A request by one of the Surrey Six murderers to halt his convictions has been denied by a B.C. Supreme Court judge. Justice Martha Devlin dismissed Cody Haevischer’s claims of police and corrections officials’ misconduct as insufficient to warrant stopping the case against him. Consequently, Haevischer’s six murder convictions and one conspiracy charge have been officially recorded, mandating a life sentence for his involvement in the crimes.

Haevischer, convicted in 2014 for the Surrey Six killings, sought to halt the legal proceedings, alleging police wrongdoing and mistreatment during his incarceration constituted an abuse of due process. Despite his plea for a case dismissal or reduced sentence, Devlin refuted most of his claims, acknowledging only a violation of his Charter rights due to solitary confinement.

Following a protracted legal battle stemming from the 2007 murders, Haevischer and his co-accused faced multiple legal challenges. While the initial convictions in 2014 were overturned, subsequent hearings culminated in Devlin’s recent ruling reaffirming Haevischer’s guilt. The judge emphasized the severity of the crimes and their enduring impact on the victims’ families.

The Surrey Six massacre, a brutal gang-related incident that resulted in six deaths, shocked British Columbia nearly two decades ago. Devlin highlighted the unparalleled cruelty of the murders, emphasizing the gravity of Haevischer’s actions and the lasting trauma inflicted on the victims and their loved ones.

Throughout her deliberation, Devlin scrutinized Haevischer’s claims of police misconduct and mistreatment in custody, assessing their impact on his right to a fair trial. Despite acknowledging some lapses in his treatment, she dismissed overarching claims of systemic abuse. Devlin also questioned Haevischer’s assertions of suffering solely due to his incarceration, pointing out other stressors in his life.

Ultimately, Devlin upheld Haevischer’s convictions, underscoring the gravity of his crimes and ensuring accountability for his role in the tragic Surrey Six murders.
