In a brief span of less than five minutes after two RCMP officers arrived in the remote island First Nations community of Opitsaht, a Tla-o-qui-aht First Nation man was fatally shot, as testified by Cpl. Daniel Macintosh during a coroner’s inquest into the death of Julian Jones on February 27, 2021. The officers responded to reports of a woman being assaulted and confined in a residence on the island around 9 p.m. PT.
This coroner’s inquest aims to investigate the circumstances surrounding Jones’s death, and the jury will formulate recommendations to prevent similar incidents without assigning blame or criminal liability. Const. David Robichaud, who discharged the shots that led to Jones’s death, was summoned to testify but has since retired from the RCMP and relocated out of the province, declining to participate in the proceedings.
The Independent Investigations Office concluded its investigation without recommending charges against the officers involved. Jones, who had prior convictions, including assaulting a Tofino RCMP officer, was prohibited from contacting several RCMP officers, including Robichaud, according to his parole officer David Paruk.
The events at the Opitsaht residence transpired rapidly, with Macintosh recounting that upon knocking on the door, they heard distress calls from inside, followed by Jones’s emergence and confrontation with the officers. Despite verbal warnings, Jones advanced towards the officers, leading to Robichaud firing a Taser at him. Subsequently, Jones continued to approach the officers, prompting Robichaud to fire multiple shots.
Following the incident, Jones’s mother reacted emotionally, and Macintosh, still armed, attempted to provide aid but refrained from intervening further due to the severity of Jones’s injuries. Macintosh reflected during the inquest that the situation might have unfolded differently if the woman had exited the house upon the officers’ arrival, potentially mitigating the tragic outcome.
Macintosh noted the absence of a second Taser as a potential alternative in the situation. Robichaud expedited his transfer out of the Tofino RCMP shortly after the incident, with the inquest proceedings set to continue on Thursday.
